This seminar seeks to analyze the impact of globalization and movement of workers on labour law relations, in particular in a private international law perspective. The seminar will focus both on individual and collective labour relations in international and European law. Specific attention will also be given to the important case law from the European Court of Justice. The first part of the seminar will focus on jurisdiction issues (jurisdiction clauses, arbitration, Brussels 1 regulation), the second on choice of law issues in matter of contract (Rome 1 regulation, Posting of workers directive) and the third one on collective labour law (collective bargaining, collective representation and collective actions). During the seminar, multiple references will be made to substantive national and EU rules, and the relationship between those rules will be subject to a thorough analysis.

Le cours vise à présenter de façon synthétique et claire la structure générale de l’ordre juridique français, dans une perspective comparative qui permettra de comparer le droit français et d’autres droits, notamment en Europe. La première partie du cours sera consacrée à présenter quelques difficultés générales du droit comparé. Nous étudierons quelques articles classiques et importants. La seconde partie sera consacrée à l’étude de la construction institutionnelle de l’ordre juridique français, notamment de l’organisation politique, administrative et judiciaire. La troisième partie, enfin, sera consacrée à l’étude de quelques concepts centraux du droit français et tout particulièrement du droit privé, dans une perspective comparative.
